These GENERAL TERMS AND CONDITIONS FOR VEHICLE RENTAL (hereinafter, the “General Terms”) govern the contractual relationship between MOOV rent-a-car (Tomitni Cars, S.L.U.) (hereinafter, the “Lessor”) and the paying customer (hereinafter, the “Renter”), under which the former grants the latter the use of a vehicle (hereinafter, the “Vehicle”) for the term, price and other conditions agreed by the parties in the signed rental agreement (hereinafter, the “Agreement”).

In the event of any discrepancy between any clause of these General Terms and the Specific Terms signed by the parties, the Specific Terms shall prevail.

The Renter is responsible for keeping the document or label corresponding to the current agreement visible in the Vehicle at all times.

1. Purpose of the Agreement: This Agreement concerns the rental of the Vehicle without a driver, as described in the Specific Terms, for the private transport of passengers and their luggage, in compliance with these General Terms.
2. Rental period: pick-up (Check-In), return (Check-Out) and extension. The minimum rental period is 1 day (24 hours) and the maximum shall be as stated in the Agreement. Rental days are calculated in 24-hour periods, with a 60-minute courtesy period from the date and time of Check-In indicated in the Agreement.

   If the above period is exceeded, the Lessor is entitled to charge the rental amount from the end of the Agreement until the Vehicle is returned, according to the current tariff, mileage, damages and a penalty for economic losses incurred. This amount accrues daily from the scheduled Check-Out date until the Vehicle is returned, recovered and prepared.

   If the Vehicle is abandoned, in addition to the above, a vehicle recovery fee of €250.00 will be charged plus all expenses and costs arising from recovery.

   If the Check-Out is carried out before the end of the rental period, no amount will be refunded, as this is considered a unilateral termination of the Agreement by the Renter.

   If the Renter breaches any of these General Terms or the Specific Terms of the Agreement, the Lessor reserves the right to repossess the Vehicle at any time and may claim damages.

   For operational inspection reasons, the Lessor reserves the right to replace the Vehicle at any time with another of similar characteristics.

   Check-In and Check-Out will take place at MOOV rent-a-car facilities or at Palma de Mallorca Airport, within the time limits and under the terms set out in the Specific Terms. MOOV rent-a-car offers Check-In and Check-Out at other locations by prior agreement, subject to the conditions and restrictions of the service, as indicated on our website and in clause 16, within the same time limits and terms stated in the Specific Terms.

   If Check-Out is not completed or the Vehicle is abandoned, the Renter will be charged the Vehicle recovery fee plus all expenses and costs arising from recovery, as well as any rental days owed, at the current General Tariff published on the Lessor’s website or at its facilities, for the period from the scheduled Check-In until the Vehicle is recovered and prepared.

   *** Please note: if Check-In or Check-Out takes place between 23:00 and 07:00, a night service surcharge applies, at a cost of €30 per pick-up and/or return.

   2.1. Extension of the Agreement: The Renter must expressly notify the Lessor in writing, by visiting the MOOV rent-a-car office where the Agreement was made at any time before the end of the rental period set out in the Agreement, or at any other MOOV rent-a-car facility.

   The minimum extension period is 1 day (24 hours) and may be extended according to the Specific Terms and the contracted Vehicle. In no case shall the initial price be applicable to an extension.

   If the Renter wishes to keep the Vehicle for longer than initially agreed, they undertake to obtain prior express authorization from the Lessor and to pay immediately the additional amount. The price applicable to the extension period shall be that stated in the current General Tariff available on the website or at MOOV rent-a-car facilities or other means the Lessor deems appropriate.

   The Lessor reserves the right to deny extensions for operational reasons. Use of the Vehicle after the end of the rental period or its extension will be considered unauthorized use for the purposes of clause 12, and a complaint for misappropriation will be filed.

3. Driver(s): The Renter and any additional drivers must be at least 18 years old, hold a valid driving licence and must present a valid European ID card or passport, both valid throughout the rental period, legible and in good condition, and accepted under Spanish law.
4. Vehicle maintenance: The Renter receives the Vehicle in optimal condition and must keep it in good condition. No modifications, interior or exterior, are allowed. Any modification and its restoration to the original condition, as well as any damages, will be charged to the Renter.

   Repairs or replacement of parts may only be carried out with the Lessor’s prior express written authorization. No repair costs will be reimbursed unless the Lessor has previously approved the estimate and the workshop. If there is no such express written approval, payment of those costs shall be the Renter’s sole responsibility. Please note that returning the car excessively dirty carries a surcharge.

5. Vehicle identification: The Renter must keep MOOV rent-a-car stickers and licence plate holders on the rented Vehicle so it can be identified. Removing these items will result in a restoration charge plus any administrative fine imposed. Under certain municipal by-laws, the Renter must also display, at all times and in a visible place, the document or label corresponding to the current Agreement. Failure to do so entails assuming the fine and paying the management fees set out in clause 13.
6. Lost property: The Renter must remove all personal belongings from the Vehicle. The Lessor is not responsible for any items found in the Vehicle. However, any item found may be sent to the Renter upon express written request to: MOOV rent-a-car, C/ Ca’n Calafat, 7 – 07199 Polígono Son Oms / Palma (Illes Balears), Spain. In such case, the Lessor will charge a handling fee for shipping plus the shipping costs, which will be borne entirely by the Renter.
7. Breakdown or accident outside the agreed rental period: Once the contractual relationship between the parties has ended, the Renter shall be responsible for 100% of the payment of any damages, repairs and expenses caused to the Vehicle and third parties.
8. Prices and tariffs: Agreement prices are in accordance with the current General Tariff displayed and available to the public at the facilities, on MOOV rent-a-car websites or other means the Lessor deems appropriate. The Renter expressly acknowledges having known the tariff prior to this Agreement. All prices are indicated in Euros (€). Fuel prices depend on the daily market rate; due to fuel price fluctuations, it is not possible to state the fuel price here.
9. Coverage: The Lessor offers different coverages with different tariffs, including:

   9.1. Green Pack: includes basic insurance and third-party liability, with a damage excess/deposit whose amount depends on the Vehicle group/category (as stated in the Specific Terms). If the optional coverage (Red Pack) is not purchased, MOOV rent-a-car will pre-authorize/charge an excess/deposit amount ranging from €500.00 to €1,375.00 (depending on group/category) on the Renter’s credit/debit card to cover any potential damage. If the Vehicle is returned in the same condition as collected, the deposit will be released within approximately 30 days, depending on the bank and the Renter’s bank processing. In case of new damage, an administrative damage charge will apply. All groups/categories include mandatory and voluntary third-party liability up to €50,000,000, medical assistance and legal defence. The Green Pack does not include roadside assistance/towing within the excess limit, nor damage to rims, tyres, glass, interior, exterior and underbody, nor loss/damage of keys; these costs will be deducted from the retained deposit.

   9.2. Red Pack: includes fully comprehensive insurance and third-party liability with no damage excess/deposit. All groups/categories include mandatory and voluntary third-party liability up to €50,000,000, medical assistance and legal defence. By purchasing this option, the Renter benefits from coverage for roadside assistance/towing and damage to rims, tyres, glass, interior, exterior and underbody. This option also waives the administrative damage management fee. Loss or damage of keys is not included, nor damage to the interior, exterior and underbody due to improper use. RESIDENTS in Mallorca cannot choose the Red Pack and may only rent with the Green Pack; otherwise, the booking will be cancelled.

   9.3. Improper or illegal use of the Vehicle: The coverage options (Green Pack / Red Pack) do not cover improper or illegal use of the rented Vehicle. The charge for unauthorized, improper or illegal use of the Vehicle is €250.00.

   9.4. Roadside assistance: This coverage includes 24-hour telephone assistance by calling one of the following MOOV rent-a-car office numbers: (+34) 971 062 086 / (+34) 644 548 062. It also includes replacement of the Vehicle and towing/roadside assistance to the location of the incident as quickly as possible (this does not apply if the incident is due to the Renter’s negligence, or to an accident or immobilization caused by crimes or offences committed with the Vehicle, as set out in clauses 11 and 12).

   9.5. General exclusions from coverage and corresponding surcharges: The coverages do not include the following services related to Vehicle damage, including structural elements such as underbody and interior/exterior equipment. Loss or damage of the Vehicle keys is not covered. No coverage will cover damage resulting from: war, natural disasters and natural phenomena (hailstorms, storms, etc.), terrorism, riots or disturbances; actions by State Security Forces, negligence by the Renter, abandonment, accident or immobilization due to crimes or offences committed with the Vehicle, and any other activity set out in clauses 11 and 12. Such damages and related services shall be borne by the Renter. Coverage does not cover personal belongings left in, stored in or transported in the Vehicle.

   9.6. Excess/deposit: Depending on the purchased coverage, a deposit will be pre-authorized/charged on a credit/debit card as a guarantee of the Renter’s obligations and any liability arising during the rental period. This deposit will be released within approximately 30 days after the end of the Agreement provided there is no incident relating to the rental and/or the Vehicle. The deposit amount depends on the category/segment of the reserved Vehicle as detailed in clause 9.1.

10. In the event of an accident, criminal act or vandalism (see clause 11) against the Vehicle, the Renter must:
    • Report the incident to the police immediately.
    • Complete an amicable accident report (European Accident Statement) using the official form in the Vehicle, stating at least the registration number, name and address of the other party, the insurer and, if possible, the policy number. Describe the accident concisely and record witness details if any.
    • Do not admit fault or accept any responsibility.
    • Do not leave the Vehicle without taking the necessary steps to protect it from further damage; lock it and do not obstruct traffic.
    • Inform MOOV rent-a-car immediately by calling the emergency numbers: (+34) 971 062 086 / (+34) 644 548 062.

    In case of accident or criminal act, the Lessor is not obliged to provide another rental vehicle. The Lessor will charge €50.00 as an administrative fee for handling each accident report. In this situation, the Agreement shall be deemed terminated and the Renter must pay all amounts arising from the Agreement.

    However, the Lessor may, although not obliged, offer a new vehicle under the terms and tariffs in force at that time to replace the Vehicle involved in the accident/criminal act/vandalism.

11. Examples of criminal or vandal acts against the Vehicle: theft or burglary of the Vehicle; theft or burglary of exterior or interior parts such as wheels, tyres or seats; break-in causing damage to windows or bodywork; vandalism against the Vehicle. This list is illustrative and not limiting.
12. Unauthorized use of the Vehicle: The Renter must use the Vehicle with due care and diligence, according to its characteristics, comply with all traffic regulations and avoid any situation that may cause damage to the Vehicle or third parties. Any breach of this clause will be considered unauthorized use.

    The Renter must not allow anyone other than authorized persons to drive the Vehicle. The Renter must pay the charge for unauthorized use and is directly responsible for any damage or loss caused to the Vehicle or third parties in such case. The Renter is fully liable for damages to interior and exterior parts due to unauthorized use.

    In the event of unauthorized use, the Renter must pay all expenses arising from such damages. The amount will be charged to the Renter’s credit/debit card, with the Renter’s express consent. The Renter’s signature on the Agreement constitutes acceptance of these General and Specific Terms.

    Unauthorized use includes, but is not limited to, the following examples:

    Participation in competitions. Illegal races. Driving without a licence/permit or without the Lessor’s authorization. Handing the Vehicle over to a third party. Pushing or towing any other vehicle. Driving in areas not suitable for public traffic such as beaches, motor circuits, etc. Driving on roads that may cause underbody/oil pan damage. Negligent action when warning lights appear on the dashboard, which the Renter acknowledges by signing the Agreement. Transporting furniture, except in vehicles designed for that purpose. Transporting animals in the Vehicle. Transporting persons or goods for payment (e.g., using the Vehicle as an illegal taxi). Subleasing the Vehicle. Carrying more passengers or luggage than permitted (according to seat belts). Carrying luggage on the roof (roof racks are not allowed). Leaving objects in plain sight in the Vehicle. Dirtying the Vehicle interior. Driving while fatigued, ill or under the influence of alcohol, medication or drugs. Reckless driving. Driving contrary to traffic regulations. Driving by a person not authorized in the Agreement (Renter/additional driver). Driving outside the permitted territory (clause 16). Using the Vehicle after the rental period has ended. Not using an infant/child seat when travelling with children under 12 or anyone under 135 cm in height. The charge for unauthorized, improper or illegal use of the Vehicle is €250.00.

13. Smoking ban inside the Vehicle: SMOKING IS EXPRESSLY PROHIBITED INSIDE THE VEHICLE. The charge for smoking inside the Vehicle is €250.00.
14. Traffic fines: The Renter is responsible for paying all fines incurred during the rental period and must inform the Lessor of any fine imposed on the Vehicle or driver during the rental period. The Lessor will charge €50.00 for notifying and managing each fine. Fine payment is not included in any coverage options. If authorities impound the Vehicle due to an act or omission by the Renter, the Renter is responsible for and shall indemnify the Lessor for all expenses and loss of profit arising therefrom.
15. Joint and several liability: All Renters and/or additional drivers shall be jointly and severally liable for all obligations assumed by the Renter in the Agreement and under applicable law.
16. Fuel policy: At Check-Out, the Renter must return the Vehicle with the same fuel level as at delivery; therefore, at Check-In and Check-Out it is mandatory to take a photo of the fuel gauge. If this condition is not met, the Lessor may charge the fuel difference plus a management fee of €25.00. Geolocation data will be used for Vehicle recovery and driving control within the permitted territory.
17. Permitted territory: The Vehicle may only be driven within the island of Mallorca. The Vehicle may not be loaded onto or transported by any means of transport without the Lessor’s prior express written authorization. Our Vehicles are equipped with geolocators; if the permitted territory is exceeded, this will be considered a breach of the Agreement and the Lessor may claim damages, terminate the Agreement immediately for breach, and take legal action.
18. Mileage: Unlimited mileage per rental period with Green Pack & Red Pack.
19. Extras: The Lessor offers baby/child seats free of charge with the Red Pack, and at the cost stated in the extras table at the end of this text for the Green Pack.
20. Payment: All services must be paid in advance by credit/debit card before the Vehicle is delivered to the Renter. Reservations made via our website can only be paid by credit/debit card. The Green Pack excess/deposit can only be captured via the credit/debit card provided by the Renter or the additional driver who appears and signs the Agreement. The deposit will be released within approximately 30 days depending on the bank used and the Renter’s bank processing. MOOV rent-a-car only accepts credit and debit cards with at least one year of validity remaining, and does not apply any surcharge for using them.
21. Currency: The Lessor’s tariffs are stated in Euros (€). Payment can be made at all facilities in the indicated currency using credit/debit cards with at least one year of validity remaining.
22. Taxes: All tariff prices include the applicable Value Added Tax (VAT). The Lessor is exempt from paying any other fee or tax that any state, regional or local authority may establish during the term of this Agreement.
23. Jurisdiction and applicable law: This Agreement is governed by all applicable Spanish legislation. The parties expressly submit to the Transport Arbitration Boards, Courts and Tribunals for any incidents and disputes arising from this Agreement, except for consumer matters, which are subject to the jurisdiction established by consumer regulations.

    22.1. In accordance with the Regulation on online dispute resolution for consumer matters (EU Regulation No 524/2013), reference must always be made to the EU online dispute resolution platform. This also applies if there is no willingness to participate in such procedure.

24. Cancellation policy: All cancellations must be made in writing to: bookings@moovrentacar.com, stating the booking number in the subject.

    Under the Green Pack, no refund will be issued except for force majeure (natural disaster, war, terrorist attack, death or serious sudden illness of the Renter, their parents, siblings or children) duly evidenced. In that case, only a date change within one year is permitted.

    Under the Red Pack, a refund will be issued if the cancellation request is made at least 48 hours (or according to the tariff) before the Agreement start date, except for force majeure (natural disaster, war, terrorist attack, death or serious sudden illness of the Renter, their parents, siblings or children) duly evidenced. Within the 48 hours before the Agreement starts, a date change within one year is permitted.

25. Customer service and complaints: If you wish to make suggestions to improve our services, please contact us at info@moovrentacar.com. All our facilities also provide official complaint forms, which will be delivered upon request.
26. Framework agreement: These terms constitute a framework agreement and apply to all rental agreements entered into by the same Renter with MOOV rent-a-car.
27. Translation: The Renter is entitled to receive a copy of these General Terms in an official language; this will be stated in versions drafted in other languages. Available languages can be consulted at our facilities. In the event of discrepancies, the Spanish version shall prevail.
28. Privacy policy: processing of personal data. Under GDPR 2016/679, personal data collected herein will be included in files owned by Tomitni Cars, S.L.U. Such personal data will be processed for the management of the Agreement and everything related to it.

    Third-party data: If you provide personal data belonging to third parties, you declare that you have the data subjects’ consent and that you have previously informed them of this privacy policy.

    Commercial communications: The Renter expressly accepts that the data contained in the Agreement may be shared to keep them informed, by email or any other means, of operational and commercial information, and for opinion surveys about products and services offered by MOOV rent-a-car or by companies forming part of Tomitni Cars, S.L.U. or entities in the same sector with which it collaborates, related to leisure, insurance, financial and automotive sectors.     Data subject rights: Data subjects may exercise their rights of access, rectification, restriction, erasure and objection by written request accompanied by a copy of their ID and sent to the address indicated above or by email to: rgpd@moovrentacar.com.
